These Terms of Use ("Terms") govern your access to and use of Timelines, including any Timelines mobile applications and websites (the "Services"), and any tracked data, information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content"). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.
The Services are intended solely for users who are thirteen (13) years of age or older and it is a violation of the Terms for anyone under 13 to create a Timelines account. Thus, you represent and warrant that you are 13 or older. If you are 13 or older, but under the age of 18, you must review the Terms with you parent(s) or legal guardian(s) to ensure that both you and your parent(s) or legal guardian(s) understand and consent to the Terms. A parent or legal guardian accepting the Terms for the benefit of a child, agrees and accepts full responsibility for his or her child's use of the Services, including all financial charges and legal liability that such child may incur.
Some parts of the Services are billed on a subscription basis ("Subscription(s)"). If you choose to purchase a Subscription, payment will be charged to your Apple ID on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
Your Subscription will automatically renew under the exact same conditions unless it is canceled at least 24 hours before the end of the current Billing Cycle. Your account will be charged for renewal within 24 hours prior to the end of the current Billing Cycle. You may manage or cancel your Subscription by going to your account settings on the App Store after purchase.
Timelines does not send invoices to customers that purchase a Subscription. Your account balance information can be accessed by going to your account settings on the App Store after purchase.
Timelines may offer you a free trial subscription period during which you can use all features of Timelines for a limited period of time. If you fail to cancel your free trial subscription, you agree to be billed according to the terms set forth in the section of these terms entitled "Subscription Payments, Renewals, and Cancellation".
Timelines, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions.
All purchases are final. Timelines cannot issue refunds for purchases charged to your Apple ID. If you have a billing dispute, you must contact the App Store to seek a remedy.
You are solely responsible for your conduct and any Content that you submit, post, and display on the Services. You must not, in the use of Services, violate any laws in your jurisdiction (including but not limited to copyright laws). Violation of any of these agreements will result in the termination of your Timelines account.
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may, but are not required to monitor or control the Content posted via the Services and we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will Timelines be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.
You retain your rights to any Content you submit, post or display on or through the Services. In order to make the Services available to you and other users, Timelines needs a license from you. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). Provided, however, that such use shall be conducted with due respect to your privacy as described in our Privacy Policy.
The Services are provided "AS IS" without any express or implied warranties of any kind. Timelines disclaims all warranties to the fullest extent permitted by law, whether express or implied, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose and non-infringement. Timelines cannot guarantee that use of the Services will be timely, uninterrupted, secure or error-free, that any defects, errors or malfunctions will be corrected, that the Services or that this Platform or the server that makes the Services available are free of viruses or anything else harmful. To the fullest extent permitted by law, Timelines undertakes no warranties or representations as to the use of the Services in terms of correctness, accuracy, adequacy, usefulness, reliability, availability or otherwise. Timelines is not liable for any communications between Timelines and you. You bear the responsibility and cost of your choice of data transmission facilities.
To the maximum extent permitted by applicable law, the Timelines Entities shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or Content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any Content obtained from the Services; or (iv) unauthorized access, use or alteration of your transmissions or Content.
In no event shall the aggregate liability of the Timelines Entities exceed the greater of one thousand Czech crowns (1000 CZK) or the amount you paid Timelines, if any, in the past six months for the Services giving rise to the claim; whichever is higher.
The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statue, tort (including negligence) or otherwise, and whether or not the Timelines Entities have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
The Services may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Timelines Entities of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
We may revise these Terms from time to time, the most current version will always be at http://www.timelinesapp.com/terms. If the revision, in our sole discretion, is material we will notify you via email to the email address associated with your account or through the Services. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
Timelines gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software that is provided to you by Timelines as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Timelines, in the manner permitted by these Terms.
